By accessing the EmpowerHer Village (“EHV”) website or applying for support services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. ELIGIBILITY REQUIREMENTS

To access EHV services, you must be at least 18 years of age and a resident of the United States. You agree to provide true, accurate, and complete information during the application process. Providing false information regarding identity, income, or household status constitutes a material breach of these terms.

3. DESCRIPTION OF SERVICES

EHV acts as a funding intermediary to provide financial vouchers for support services to eligible families in the “missing middle” income gap. EHV is not a direct provider of childcare, medical, or mental health services and does not employ the professionals providing such care. We solely provide the financial means to access these services through third-party platforms.

4. GOVERNMENT VERIFICATION WORKFLOW

To qualify for EHV assistance, applicants must first screen for eligibility through state government portals (e.g., NC DHHS Child Care Subsidy). EHV services are strictly reserved for those deemed ineligible for public assistance due to income thresholds. Applicants must submit proof of denial or waitlist status to verify eligibility.

5. VOUCHER PROGRAM RULES

Vouchers issued by EHV are subject to strict usage conditions:

Misuse of vouchers will result in immediate termination of services and potential legal action to recover funds.

6. DONATIONS & PAYMENTS

Donations made to EHV are tax-deductible to the extent allowed by law. Payments are processed via secure third-party processors. Donations are generally non-refundable unless required by applicable law.

7. USER CONDUCT

You agree not to use the Site or Services for any unlawful purpose, to harass others, or to interfere with the operation of the Site. EHV reserves the right to terminate access for violations of this conduct policy.

8. THIRD-PARTY PLATFORMS

Services are fulfilled through partner platforms. Your use of these platforms is subject to their separate Terms of Service and Privacy Policies. EHV is not responsible for the quality, safety, or reliability of services provided by third-party vendors or the professionals hired through them.

9. INTELLECTUAL PROPERTY

All content on the Site, including text, graphics, logos, and software, is the property of EHV or its licensors and is protected by copyright and other intellectual property laws.

10. DISCLAIMERS & NO WARRANTIES

THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. EHV DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE regarding the services funded by our vouchers.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by law, EHV shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, incurred by users or service recipients arising from the use of funded services.

12. INDEMNIFICATION

You agree to indemnify and hold harmless EHV, its officers, directors, employees, and agents from any claims arising out of your use of our services, violation of these Terms, or infringement of any rights of another.

13. GOVERNING LAW

These Terms shall be governed by the laws of the State of North Carolina. Any disputes shall be resolved through binding arbitration in Charlotte, NC, unless you opt out within 30 days.
